1. Overview
Welcome to WordPressFix! This Universal Terms of Service Agreement (this “Agreement”) is a legal agreement between you and WordPressFix, a division of the Hostrings ecosystem (“WordPressFix”, “we”, “us” or “our”), operator of wordpressfix.org (the “Site”). This Agreement becomes effective on the date you first use the Site or the date of your electronic acceptance, whichever comes first.
By using the Site and any products or services accessed, ordered or purchased through it — including website repairs, security and malware removal, speed optimization, migrations, backups, managed infrastructure, custom development and related work (collectively, the “Services”) — you agree to the terms and conditions set out in this Agreement. Certain Services may carry additional policies or service agreements that supplement, rather than replace, this Agreement. If any conflict arises between a specific service agreement and this Agreement, the specific service agreement controls for that Service.
If you use the Site or Services on behalf of a company or another person, you confirm that you have the authority to bind them to this Agreement.
2. Our Services
WordPressFix provides professional repair, maintenance, security, performance, migration, backup, infrastructure and development services for WordPress websites. Unless expressly stated otherwise in writing:
- Every engagement begins with a free assessment, after which we provide a written scope and a fixed quote. Work begins only after you accept the quote.
- Advertised “from” prices (for example, “from $150 USD”) are starting prices for standard single-site work. Your final price is the one stated in your accepted quote.
- Delivery estimates are made in good faith. Timelines that depend on third parties — hosting companies, domain registrars, payment gateways, Google review processes — are outside our control and are estimates only.
- We may decline any engagement at our discretion, including for the reasons described in the Acceptable Use section below.
3. Your Responsibilities
- Authority. You confirm that you own the website concerned or are authorized by its owner to commission work on it.
- Access. Many Services require access credentials (WordPress admin, hosting control panel, SSH, domain registrar). You are responsible for providing correct, current credentials and for rotating them after work completes. We treat all credentials as confidential and use them only for the agreed work.
- Accuracy. You are responsible for the accuracy of the information you provide about your website, its history and its problems. Diagnoses and quotes are based on that information plus our own assessment.
- Your own backups. Independent of anything we do, you are responsible for maintaining your own local copies of your website data at all times.
4. Website Backup Policy
Before performing substantive work on your website, we take a safety backup as standard practice. Upon completion of website work, we can provide you with a backup copy of your website; for dynamic websites, backup data is stored in your web hosting account.
Retention: unless you are subscribed to a backup or care plan that states otherwise, you may keep one backup at a time in your individual account, retained for up to 3 days. Backups older than 3 days may be deleted. It is your responsibility to download and safely store the backup file within that period to prevent data loss.
Although backups are performed with care, WordPressFix will not be held responsible for any loss of data. It remains your responsibility to ensure that you maintain a local copy of your web data for your own backup purposes. Customers on our Backup & Disaster Recovery service or care plans receive the extended schedules and retention described in those services.
5. Acceptable Use Policy
The internet is a powerful tool, and we expect our customers to use it with respect, courtesy and responsibility, with due regard for the rights of other internet users. This policy is strictly enforced: we decline or discontinue work, and where applicable remove offending material from infrastructure we manage, as soon as a violation is discovered, and we will inform you when and why any such action is taken. Common sense should guide what constitutes acceptable use, but the following are unacceptable in connection with any website we are asked to work on or any infrastructure we manage:
- Illegality. Any form of illegal activity, including but not limited to unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, or trafficking in obscene material.
- Undesirable content. We do not work on or host pornographic content of any description, and we reserve the right to determine what constitutes such content. Content relating to hacking tools, cracking, warez or pirated software distribution is not accepted. (Removing malware and repairing hacked websites is, of course, exactly what we do — this clause concerns websites that distribute such material.) Software downloads may only be hosted where you are the author and copyright owner.
- Bulk email and spam. Infrastructure we manage may not be used to send bulk unsolicited email or to support spam campaigns. As a guideline, sending more than 150 emails at once is considered bulk email; legitimate transactional and opt-in mail through properly configured services (see our email service) is not affected.
- Misuse of resources. On managed infrastructure, applications that consume excessive CPU, memory or storage, maintain constant abusive connections, or exist to provide free file/image/media hosting services to third parties are not permitted. Fair-usage limits for managed and care-plan services are applied reasonably and communicated when relevant.
- Deceptive use of protected areas. Use of password-protected directories to conduct or conceal illegal activity is strictly prohibited.
6. Fees and Payments
- Prices and fees displayed on the Site are subject to change without prior notice until fixed in an accepted quote; among other factors, international currency rates fluctuate over time. Once you accept a written quote, that price is fixed for the quoted scope.
- Project work (development, builds, larger engagements): no payment is due to commence scoping. 50% of the total is charged once you approve the initial demonstration or staging preview, and the remaining 50% is charged on completion of the work.
- Repairs and smaller services may be payable in full in advance or on completion, as stated in your quote.
- Advance payments are non-refundable once the corresponding work has begun.
- There are no hidden or additional charges beyond what has been agreed in your quote. If you change the scope, the quote is revised with you — never silently.
- We adhere to a fair usage policy on recurring plans.
7. Refund Policy for Digital Products and Services
Because the products we offer are digital goods and professional services, they are not eligible for traditional returns:
- Digital products (themes, plugins, licenses, downloadable deliverables): not returnable once downloaded. We may be able to provide a refund if the item has not yet been downloaded. Before purchasing, please review any demo we offer and read the applicable terms carefully so you are fully informed.
- Services: completed work is non-refundable. Where work has not yet begun, prepaid amounts may be refunded at our discretion. Where a service carries an express guarantee (for example, re-cleaning during a stated monitoring window after malware removal), that guarantee is honored as described on the relevant service page.
8. Third-Party Services and Software
Your website depends on services and software we do not control — hosting companies, domain registrars, CDNs, payment gateways, plugin and theme vendors, and WordPress itself. We are not responsible for the acts, omissions, outages, pricing or policy changes of third parties. Where a Service involves purchasing something on your behalf (hosting, licenses, certificates), those purchases are governed by the third party’s own terms and billed transparently at cost unless otherwise agreed.
9. Disclaimers and Limitation of Liability
Services are provided with professional skill and care, but — to the maximum extent permitted by law — they are provided “as is” and without warranties beyond those expressly stated in writing. We do not guarantee specific search-engine rankings, uninterrupted operation of your website, or outcomes controlled by third parties. To the maximum extent permitted by law, WordPressFix’s total aggregate liability arising out of or relating to any Service shall not exceed the amount you paid for that Service, and we shall not be liable for indirect, incidental, special or consequential damages, including lost profits or lost data. Nothing in this Agreement excludes liability that cannot be excluded under applicable law.
10. Trademarks and Affiliation
WordPressFix provides independent WordPress services and is not affiliated with, endorsed by, or sponsored by the WordPress Foundation, Automattic Inc., or WooCommerce. “WordPress” and “WooCommerce” are trademarks of their respective owners and are used on this Site solely to describe services compatible with that software. The WordPressFix word mark is a trademark of Hostrings Technology.
11. Changes to These Terms
We may revise this Agreement from time to time. The “Last Revised” date at the top of this page reflects the current version, and continued use of the Site or Services after a revision constitutes acceptance of the revised Agreement. For material changes affecting an active engagement, the terms in force when you accepted your quote continue to apply to that engagement.
